By accessing or using our website, booking a safari, or engaging with our services, you (“you,” “your,” “the customer”) agree to comply with and be bound by these Terms and Conditions.

1. General Terms

  • Eligibility: To use our website and book our safaris, you must be at least 18 years old or have the legal capacity to enter into binding contracts.

  • Agreement: By making a booking or using our website, you confirm that you have read, understood, and agreed to these Terms and Conditions, along with any other policies referenced here, including our Privacy Policy, Cancellation and Refund Policy, and Payment Policy.

  • Changes: We reserve the right to modify or update these Terms and Conditions at any time. Any changes will be posted on this page with an updated “Last Updated” date. We recommend reviewing this page periodically for any updates.


2. Booking and Reservations

a) Booking Process

  • Booking Confirmation: A booking is considered confirmed when you receive a Booking Confirmation email after your deposit has been processed and payment is received.

  • Deposit: A non-refundable deposit of [insert percentage] is required to confirm your reservation. This deposit is part of the total tour cost and will be applied to your final payment.

  • Final Payment: The remaining balance is due at least [insert number] days before the start of your safari. If payment is not received by the due date, we may cancel your booking and retain the deposit.

  • Individual Group Members: Each person within a group must individually agree to these Terms and Conditions.


3. Price and Payment

a) Pricing

  • Prices: Prices for our safaris are subject to change and will be confirmed at the time of booking. Any changes in price will be communicated to you before your booking is confirmed.

  • Currency: All prices are quoted in USD (United States Dollar), EUR (Euro), or the local currency (Kenyan Shilling or Tanzanian Shilling), depending on the booking agreement. Payments must be made in the currency specified in your booking.

b) Payment Methods

We accept payments via bank transfer, credit/debit cards (Visa, MasterCard, American Express), and online payment platforms (e.g., PayPal, Stripe). All payments are processed securely via third-party payment gateways.

  • Security: We implement reasonable measures to protect your payment details, but we are not responsible for any errors or fraud by third-party processors.


4. Cancellations and Refunds

a) Customer Cancellations

  • If you wish to cancel your booking, you must notify us as soon as possible. Cancellations will be processed according to the terms outlined in our Cancellation and Refund Policy.

  • Refunds: Refunds, if applicable, will be issued according to the cancellation timeline, and may be subject to the cancellation fees and non-refundable deposits as outlined in our Cancellation and Refund Policy.

b) Cancellations by Us

We reserve the right to cancel any booking due to unforeseen circumstances, such as political unrest, weather conditions, or force majeure events. If we cancel your safari, you will receive a full refund of any amounts paid, or we may offer you an alternative safari package or date.


5. Responsibilities of the Traveler

a) Travel Documents

You are responsible for ensuring that you have the correct documentation for travel, including:

  • A valid passport (with at least six months validity before travel)

  • Any necessary visas for Kenya and Tanzania

  • Health or vaccination certificates (e.g., yellow fever vaccination)

  • Any other documents required by local authorities

b) Health and Fitness

You must ensure that you are in good health and physically fit to participate in our safaris. Some activities, such as walking safaris or hikes, may require a certain level of fitness. If you have any medical conditions that may affect your ability to participate, you must inform us at the time of booking.

c) Travel Insurance

We highly recommend that you obtain travel insurance to cover medical emergencies, cancellations, lost luggage, and other unforeseen events. We are not liable for any injuries, damages, or losses that may occur during the safari.


6. Modifications to Bookings

  • Changes to Your Itinerary: If you wish to modify your booking (e.g., change your travel dates, accommodations, or tour package), please contact us at least [insert number] days in advance. Modifications are subject to availability and may incur additional fees.

  • Alternative Arrangements: If modifications are not possible, we will assist you in selecting an alternative tour or destination. If we cannot accommodate your requested changes, we will refund any amounts paid (less applicable cancellation fees).

a) Assumption of Risk

  • Travel Activities: Participation in safaris and adventure activities involves inherent risks, including the risk of injury, illness, loss of property, or death. You assume full responsibility for these risks when you book a safari.

  • Animal Interactions: While we take all reasonable precautions, safaris may involve close encounters with wildlife. We are not responsible for any accidents, injuries, or damage that may result from wildlife encounters.

b) Indemnity

  • You agree to indemnify and hold harmless Spirit of Tanzania Safaris, its employees, agents, and partners from any claims, losses, or damages resulting from your participation in the safari or violation of these Terms and Conditions.


8. Force Majeure

We are not liable for any delay, failure, or inability to perform our services due to events beyond our control, including but not limited to:

  • Natural disasters, extreme weather conditions, pandemics, or other health crises

  • Political instability, war, civil unrest, or government action

  • Airline or transport cancellations or delays

In such cases, we may offer alternative arrangements, reschedule the safari, or provide a refund in accordance with our Cancellation and Refund Policy.


9. Privacy and Data Protection

Your personal information will be processed according to our Privacy Policy, which outlines how we collect, store, and protect your data. By booking with us, you consent to the collection and use of your data as described in our Privacy Policy.


10. Governing Law and Dispute Resolution

  • These Terms and Conditions shall be governed by and construed in accordance with the laws of [insert country].
